Welcome to the santatheexperience.com website. It is our goal to make this virtual Santa experience as pleasant as possible for you and your family.

Below are the Terms and Conditions of your experience. By making a purchase on our site, you agree to all of these provisions.

Refunds, Appointment and Rescheduling.
Before purchasing, carefully review your selected appointment time for the experience and ensure you can keep it. Sales are final. You must sign in at least 5 minutes before your appointment time to be set up in our que. Any request to reschedule must be made at least 72 hours in advance of your appointment and must be completed via our website self help tool (under MANAGE, log-in and then click CHANGE TIME) and depends on availability at the price you purchased at or less. Requests within 72 hours are at our sole discretion and may not be possible. Late sign-ins or no-shows are considered non-refundable cancellations.

Your Computer and Connection.
You are responsible for connecting to the Zoom.com link provided in your appointment confirmation. Check your Internet connection at zoom.us/test in advance of your appointment to make sure your microphone, video and audio is working. There are no refunds or rescheduling due to technical difficulties with your equipment or Internet connection. If we alone have technical or other difficulties fulfilling obligations on our end, we will reschedule to a mutually agreeable time, or at our sole discretion, issue a refund.

Santa is an Art, Not a Science.
The entire Santa experience is for entertainment value only. As with any artistic performer, the interaction will vary depending on which Santa is assigned to your experience. While we make every reasonable effort to interview and screen our Santa’s for their artistic skills, we do not guarantee any specific outcome of any appointment. Further, Santa’s representations of gifts or holiday wishes are for the good feelings of the participants, and will not always come true. Therefore, you may not “charge back” your credit card merely because the experience is not what you or your family had wished or hoped it would be.

Maximum Liability of the Parties.
Regardless of the reasons for any such claim, the maximum liability of the parties shall be a full refund of the amount paid by the customer to us (including any service fees). Under no circumstances shall any general, punitive, or exemplary damages be paid to any party.

Language.
Our Santas communicate in the English language only. We do not offer translation services. If any member of your group requires any form of language translation, you must provide the translator. Time for your appointment will not be extended due to translation delays.

Recordings.
We record sessions for the sole purposes to create the Elftastic package (photos/video/nice list certificate), for quality assurance, or in the event of a fradulent payment dispute (charge back), we will use recording to provide the bank as evidence. We do not use the recordings for any marketing purporses. You may purchase a recording of the session for your memories based on our published fees. All recordings are deleted within 30 days from Zoom, the edited Elftastic assets will remain on our server so you can download them for 2 months at which they will be deleted and irretrievable, it is your responsibility to save them before deletion. You also represent to us that you have obtained the express consent of all persons in your party to their being recorded. In the event anyone in your party brings an action against us related to such a recording, you agree to indemnify and hold us harmless for such claims, including separate parental consent for minors if applicable.

Attire.
At all times, participants must wear appropriate attire consistent with the family atmosphere of a Santa experience. No participant may wear clothing that is offensive or excessively revealing.
